Terms of Service
Welcome to Gaitkeeper! These Terms of Service ("Terms") govern your use of the Gaitkeeper application (the "App") operated by Studio Apricity ("we," "us," or "our").
By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
By creating an account or using the App, you confirm that:
- You are at least 13 years of age
- You have the legal capacity to enter into these Terms
- You will comply with these Terms and all applicable laws and regulations
- You have read and agree to our Privacy Policy
If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.
2. Description of Service
Gaitkeeper is a progressive web application (PWA) for dog show management that allows users to:
- Track dog show entries, results, and championship points
- Store photos, videos, voice notes, and memories from shows
- Find upcoming dog shows
- Track judges and personal notes
- Manage health documents and expiration reminders
- Track show-related expenses
- Share dog profiles with co-owners and breeders
- Generate reports and summaries of your show career
3. Account Registration
Account Creation
To use the App, you must create an account by providing:
- A valid email address
- A password (minimum 8 characters)
- Confirmation that you are at least 13 years old
- Acceptance of these Terms and our Privacy Policy
You may also sign in using Google authentication.
Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use at gaitkeeper.app@gmail.com
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription and Payments
GaitKeeper is currently in beta and is free to use during this period. No credit card is required.
When the beta period ends, we may introduce paid subscription tiers. If we do, you will be notified in advance with full details on pricing, features, and any changes to your account. You will never be charged without your explicit consent.
If paid subscriptions are introduced in the future:
- Payments will be processed securely through a third-party payment provider
- We will not store your credit card information
- All prices will be in US dollars
- You will receive at least 30 days' notice before any charges apply
5. Billing and Cancellation
During the beta period, the App is free and no billing applies. If paid subscriptions are introduced in the future, you may cancel at any time. Cancellation details will be provided at that time.
6. User Content and Ownership
Your Content
You retain full ownership of all content you upload to the App, including:
- Photos, videos, and voice notes
- Dog profiles and information
- Show results and notes
- Journal entries
- Health documents
License to Us
By uploading content, you grant us a limited, non-exclusive license to:
- Store, process, and display your content to provide App functionality
- Create backups of your content
- Display your content to users you have authorized (such as co-owners)
This license exists solely to operate the App and terminates when you delete your content or account.
Content Restrictions
You agree not to upload content that:
- Infringes on any third party's intellectual property rights
- Is illegal, harmful, threatening, abusive, or harassing
- Contains malware, viruses, or malicious code
- Violates any applicable law or regulation
7. Acceptable Use
You agree NOT to:
- Use the App in any way that violates applicable law
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App or servers
- Use automated systems (bots, scrapers) to access the App without permission
- Impersonate any person or entity
- Collect or harvest user data without authorization
- Use the App to transmit spam or unsolicited communications
- Reverse engineer or decompile the App
8. Point Calculations Disclaimer
Gaitkeeper is NOT affiliated with the American Kennel Club (AKC) or United Kennel Club (UKC).
Point calculations provided by the App are estimates only based on publicly available point schedules. These calculations may contain errors or may not reflect the most current point schedules.
Always verify your official points and standings through:
- AKC: www.akc.org
- UKC: www.ukcdogs.com
We are not responsible for errors in point calculations, incorrect show information, missed entry deadlines, or any decisions you make based on information in the App.
9. Show Finder Data Disclaimer
Show listings in the App are community-sourced and may not reflect official AKC or UKC records. Information may be incomplete, inaccurate, or outdated.
Always verify show details with the hosting club, show superintendent, or official event listings.
10. Intellectual Property
Our Property
The App, including its design, features, code, graphics, and branding, is owned by Studio Apricity and protected by intellectual property laws.
"Gaitkeeper," the Gaitkeeper logo, and "Studio Apricity" are trademarks of Studio Apricity.
Third-Party Trademarks
"American Kennel Club," "AKC," "United Kennel Club," and "UKC" are registered trademarks of their respective organizations. Gaitkeeper is not affiliated with, endorsed by, or sponsored by these organizations.
11. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your information.
12. Third-Party Services
The App integrates with third-party services including:
- Stripe — Payment processing
- Supabase — Data storage and authentication
- Netlify — App hosting and content delivery
- OneSignal — Push notifications
- Sentry — Error tracking and crash reporting
- Resend — Transactional email
- Google — OAuth authentication
Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
13. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not warrant that:
- The App will be uninterrupted, secure, or error-free
- Results obtained from the App will be accurate or reliable
- Any errors in the App will be corrected
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUDIO APRICITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Studio Apricity, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Content you upload to the App
16. Account Deletion and Data
Requesting Deletion
You may delete your account at any time by:
- Using the "Delete Account" feature in Settings
- Contacting us at gaitkeeper.app@gmail.com
90-Day Grace Period
When you request account deletion, your account enters a 90-day grace period. During this time:
- Your account is deactivated and inaccessible
- Your data is retained but not processed
- If you log back in, your account is reactivated and the deletion is cancelled
- You will receive reminder emails at 60 days and 80 days
After 90 days, all your data is permanently and irreversibly deleted, including all dogs, shows, results, media files, health documents, and account information.
Export Before Deletion
We strongly recommend exporting your data before requesting deletion. Use the Export feature in Settings to download a complete copy of your data.
17. Dispute Resolution
Informal Resolution
Before filing any formal claim, you agree to contact us at gaitkeeper.app@gmail.com and attempt to resolve the dispute informally for at least 30 days.
Arbitration
If informal resolution fails, disputes shall be resolved by binding arbitration in accordance with the American Arbitration Association rules. Arbitration shall take place in Arizona.
Class Action Waiver
You agree to resolve disputes with us on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.
18. General Provisions
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Studio Apricity regarding the App.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, internet or power failures, or pandemics.
Waiver
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
Notices
We may send you notices via email, in-app notifications, or by posting on the App. You may send notices to us at gaitkeeper.app@gmail.com.
